20-minute meal break on six-hour days

On a workday of six or more hours, make at least 20 minutes available for a meal break at a time you reasonably designate — unless the crew already gets necessary breaks or may eat while working. The 20-minute minimum does not grow when the shift gets longer. Breaks of 20 consecutive minutes or less are paid time. A bona fide meal that typically lasts 30 minutes or longer may be unpaid if the employee is relieved of duty. Write whether you use on-duty eating, a 20-minute paid pause, or a 30-minute unpaid meal.

Final paycheck by the next payday

When someone quits, resigns, or is discharged, pay wages earned before separation on or before the next regular payday — the same clock either way. West Virginia no longer uses the old 72-hour discharge rule. Layoffs also pay on the next regular payday. Fringe benefits follow the written agreement if it sets a later date or extra conditions. If you withhold final wages for unreturned tools or uniforms over $100, you need a signed itemized agreement and the notice steps in §21-5-4. Miss the deadline and liquidated damages can be two times the unpaid amount.

Hire wage notices and WPCA poster

At hire, notify employees in writing of the rate of pay and the day, hour, and place of payment. Give written notice at least one full pay period before you change rate, payday, place, or method of payment. Furnish an itemized statement of deductions each pay period. Keep the Division of Labor’s Wage Payment and Collection Act abstract posted where the crew can see it. Regular paydays must fall at least twice a month with no more than 19 days between them unless the Commissioner approved a special agreement.

Minimum wage $8.75 and tip credit

When six or more non-exempt employees work at one separate, distinct, and permanent West Virginia location, the state minimum wage is $8.75 an hour (in effect since 2016). Smaller locations may fall under the federal $7.25 rate — confirm which law applies. Covered employers may take a 70% tip credit and pay tipped staff a $2.62 cash wage if cash wages plus tips average at least $8.75 for the week; otherwise you make up the difference. Keep written tip records. Most shops follow federal FLSA overtime, not a separate state overtime rule.

Youth age certificates and hours

Fourteen is the usual minimum age for gainful work. Fourteen- and 15-year-olds need a Division of Labor age certificate before they start — including out-of-state teens working in West Virginia — with a job promise, parental consent, school status, and proof of age. They may not work more than five hours continuously without a 30-minute lunch. School-year hour and night limits still apply. Sixteen- and 17-year-olds may work adult hours; an age certificate is optional unless you require one for workers’ compensation. Hazardous occupations (mining, logging, power-driven machines, roofing) stay off-limits for minors.

Pregnancy accommodations

The Pregnancy Workers’ Fairness Act makes it unlawful to refuse reasonable accommodations for known limitations related to pregnancy, childbirth, or related medical conditions after the worker provides health-care documentation — unless the change would impose an undue hardship. You may not force leave if another accommodation would work, or force an accommodation the worker does not accept. Pair that with Human Rights Act sex-discrimination rules.
